Terms & Conditions

Welcome to Fanifo Lofa. By paying your deposit and confirming your booking, you explicitly agree to the following terms, conditions, and operational policies of our remote, off-grid eco-retreat.

1. Booking & Payment Structure

To secure your requested accommodation dates, meal packages, and licensed whale swim experiences, the following structured payment plan applies:

  • Initial Deposit: A 30% deposit is required immediately to confirm and secure your booking.
  • Second Deposit: A 20% payment is due 6 months prior to your scheduled arrival date.
  • Final Balance: The remaining 50% balance is due 3 months (90 days) prior to your arrival date.

Please note: Accommodation packages at Fanifo Lofa Ltd include both accommodation and mandatory full-board meal plans. Timely payments are the guest’s responsibility. Reservations not adhering to this payment schedule will be canceled without notice or refund.

2. Accepted Payment Methods & Fees

  • Bank Transfer: Deposits and balances can be paid via international bank wire transfer or direct deposit. Guests must cover all sender and intermediary bank fees associated with the transfer so the exact invoiced amount is received.
  • Credit Cards: Visa and MasterCard are accepted for bookings and incidental charges incurred during your stay. Credit card transactions are processed in Tongan Pa’anga (TOP) and are subject to a 5% processing fee.
  • On-Island Incidentals: Any additional snacks, drinks, or transfers incurred during your stay can be settled on-site via bank transfer, cash (major international currencies accepted), or credit card (5% fee).

3. Arrival, Departure & Guest Requirements

  • Minimum Stay: We operate on a standard minimum stay of 7 nights. Fewer nights may occasionally be approved strictly by prior request.
  • Check-In / Check-Out: Standard check-in time is 2:00 PM. Check-out times will vary depending on your onward travel schedule, typically around 9:00 AM.
  • Dietary Requirements: Because getting specialty items to the remote Ha’apai island group takes time, guests must notify us of any and all food allergies or specific dietary requirements at the time of booking.
  • Travel Itineraries: Guests must provide us with their domestic flight and/or alternate local accommodation itineraries as soon as they are booked so we can coordinate your arrival transfers.

4. Non-Refundable & Non-Transferable Policy

  • Strict Policy: All deposits, interim payments, and final balances are strictly non-refundable and non-transferable to other parties or other dates under any circumstances.
  • Cancellations: If you cancel your booking, you will forfeit 100% of the invoice, payments, and deposits made. All cancellations must be submitted in writing via email.
  • External Factors: This non-refundable policy applies to all situations, including those beyond your or our control. This includes, but is not limited to: ill health, medical emergencies, inclement weather, rough marine conditions, airline strikes, domestic or international flight cancellations/delays, ferry disruptions, pandemics, or acts of war.
  • Group Bookings: Group reservations may be subject to additional bespoke terms and conditions, which will be specified explicitly at the time of the group booking.
  • See https://fanifolofa.com/refund-cancellation-policy/ for more details

5. Rate Adjustments & Surcharges

  • Seasonal Adjustments: Retail prices are subject to change from year to year. If a booking is held or rescheduled at the discretion of Fanifo Lofa Ltd, it may be subject to current-year price updates.
  • Global Situations & Surcharges: Prices are subject to change for both existing paid bookings and future bookings if a worldly situation arises that warrants a necessary adjustment (e.g., extreme increases in local fuel costs, freight, or food supply costs). In these rare instances, a justified surcharge may incur.

6. Third-Party Operators & Mandated Travel Insurance

  • Fanifo Lofa Ltd acts as an owner-operated remote retreat and is not responsible for any changed travel plans, delays, or cancellations caused by Lulutai Airlines, local ferry systems, or any other third-party transportation providers.
  • Mandatory Insurance Recommendation: Because of our strict non-refundable policy and remote island environment, we highly and strongly recommend that all guests purchase comprehensive travel insurance at the time of booking. Your policy should cover trip cancellation, medical emergencies, evacuation, and activity disruptions due to weather.

7. Liability & Waiver

By paying your deposit, confirming your booking, and entering our premises, you agree to hold harmless and waive all claims of liability to Fanifo Lofa Ltd, as well as all of its shareholders, directors, employees, and associates for any personal injury, loss, or damage to personal property sustained during your stay or during activities (including kitesurfing, wing foiling, and whale swimming).
